The tips on Word and Excel have been invaluable tools to help me do my job. I did not grow up using Word and Excel. I started with a typewriter and have been learning new technology ever since. I love technology, and I think it gets more intuitive all the time.  But, if I do not use it often, I can get stuck. When I need a hand, I have found the tips on Word and Excel especially helpful. Even better, both the Word and Excel tips have newsletters and answer questions from readers.  The tools are out there. You just have to find them. The practical household tips are an extra plus. As pointed out in this article, more courts require e-filing and are using tablets and other technology to read what you file. If you do not use technology, then you do not know how your document appears on the screen. It is quite different than reading something on a printed page.

Do-It-Yourself Digital Discovery [Originally published in Law Technology News, May 2006]

Recently, a West Texas firm received a dozen Microsoft Outlook PST files from a client. Like the dog that caught the car, they weren’t sure what to do next.  Even out on the prairie, they’d heard of online hosting and e-mail analytics, but worried about the cost. They wondered: Did they really need an e-discovery vendor? Couldn’t they just do it themselves?

As a computer forensic examiner, I blanch at the thought of lawyers harvesting data and processing e-mail in native formats. ‘Guard the chain of custody,’ I want to warn. ’Don’t mess up the metadata! Leave this stuff to the experts!’ But the trial lawyer in me wonders how a solo/small firm practitioner in a run-of-the-mill case is supposed to tell a client, ‘Sorry, the courts are closed to you because you can’t afford e-discovery experts.’

Most evidence today is electronic, so curtailing discovery of electronic evidence isn’t an option, and trying to stick with paper is a dead end. We’ve got to deal with electronic evidence in small cases, too. Sometimes, that means doing it yourself.

The West Texas lawyers sought a way to access and search the Outlook e-mail and attachments in the PSTs. It had to be quick and easy. It had to protect the integrity of the evidence. And it had to be cheap. They wanted what many lawyers will come to see they need: the tools and techniques to stay in touch with the evidence in smaller cases without working through vendors and experts.

What’s a PST?

Microsoft Outlook is the most popular business e-mail and calendaring client, but don’t confuse Outlook with Outlook Express, a simpler application bundled with Windows. Outlook Express stores messages in plain text, by folder name, in files with the extension .DBX. Outlook stores local message data, attachments, folder structure and other information in an encrypted, often-massive database file with the extension .PST. Because the PST file structure is complex, proprietary and poorly documented, some programs have trouble interpreting PSTs.

What About Outlook?

Couldn’t they just load the files in Outlook and search? Many do just that, but there are compelling reasons why Outlook is the wrong choice for an electronic discovery search and review tool, foremost among them being that it doesn’t protect the integrity of the evidence. Outlook changes PST files. Further, Outlook searches are slow, don’t include attachments (but see my concluding comments below) and can’t be run across multiple mail accounts. . . . .

But Microsoft is sending its Office clip art to the digital beyond, where it shall rest in glory with Clippy, Zune, and the rest of the Redmond saints.

In other words, those wonky, yet charming images that graced countless PowerPoint presentations are in their last days. Microsoft already nixed the website where you could download Clip Art, so it may not be long before it disappears from Office entirely.

These guys won’t be around much longer.

So it’s time for a different plan. The good news is that Office already has better options for spicing up your files than relying on the dated and questionable-looking Clip Art. For example, Office’s integrated Bing Images search is solid, parsing the web for copyright-free images that you can use to bring some life to the staid world of business presentations.

iPhone J.D. turns six years old this week.  Seems like it was just yesterday that I wrote the first post on iPhone J.D., explaining why I found the iPhone a valuable tool in a law practice.  Back then, almost no attorneys used iPhones (about 5% according to a 2008 Am Law Tech Survey), but now the majority of attorneys in the U.S. use an iPhone (around 60% according to the ABA).

Over the past six years, I’ve written over 1,200 posts on iPhone J.D., including reviews of over 300 apps, reviews of every major iOS device released by Apple (from the iPhone 3GS to the new iPhone 6 and all models of the iPad) and reviews of over 300 accessories.  I’ve also tried to provide lots of tips and tricks for getting the most out of your iPhone and iPad, and discussed all of the tech news that I think that you might want to know about if you use an iPhone or iPad.

Through the years, I’ve gotten tons of great feedback from iPhone J.D. readers, ranging from emails to over 2,500 comments on the site, and I’ve been honored to share guests posts by attorneys from around the world who use iPhones and iPads in their law practice.  Site traffic has grown steadily every year, and in just a few days, one of you is going to load iPhone J.D. and it will be the 5 millionth page view since the site launched.

Android users who sync their Google calendars with Outlook received a shocking email:

Important Announcement about Google Calendar Sync

Almost two years ago, we announced that we ended support for Google Calendar Sync. Starting on August 1, 2014, this app will no longer sync events between your Google Calendar and Microsoft Outlook Calendar.

As a Google Apps for Business, Education, or Government customer, you can use Google Apps Sync for Microsoft Outlook®.

Follow these instructions to uninstall Google Calendar Sync from your computer.

This is frustrating, because as some folks point out, Microsoft should provide this integration for Outlook users. But the truth is, instead of helping its loyal Android customers, Microsoft wants more people using Windows phones and Office 365. This news makes many Android-Outlook users want to abandon their Android devices all together.

Purely out of coincidence, I have a local friend who emailed me a similar question about syncing his calendar with Outlook:

You know that I am fairly stupid when it comes to this stuff!  LOL!  I use [a big name telephone company] as my primary email, and too many people have it to change it after so many years.  I guess I could keep that as my primary email address and just use Google Calendar exclusively.  I just hate to have to log in to use the calendar.  Lazy I guess.  I do, however, also have a Gmail address!  Any suggestions other than ‘using all of Google’s products’?

Stop the insanity: software solutions

There are a number of third party applications available for syncing Google Calendar with Outlook. However, a lot of questions remain about whether Google Calendar will still sync with third party programs.

If you want to test them, here’s a short list of some programs with good reviews:

•gSyncit ($19.99 single license)

•Outlook4Gmail ($19.99 single license)

•Calendar Sync Pro for Outlook ($9.99)

•synqYa

•CompanionLink ($49.95)

I’m not sure how well these will work after the August 1 deadline, though gSyncit indicates they’ve rewritten their program to coordinate with Google’s API demands. If I was going to pick an option, I’d probably select gSyncit based on that statement.

I also suggest you keep up to date with any advances by following this Google products forum thread.

Submit yourself to “the Borg”

I think my friend’s easiest option is to commit himself to Google’s services, and here’s why.

First, no attorneys should be using free Google accounts for their business work. Thus, if you’re using a yourname@gmail.com to send and receive firm and client related information, stop right now. Sign up for a Google Apps account — ask me for a referral partner discount discount code — that offers more features (including no scanning), security, and encryption of email. Having a Google Apps account also enables you to access Google Apps Sync for Microsoft Outlook. . . .

Think you can write? Do these four things.

First, pull out the last brief that you wrote.

Not that one — that’s the final version, edited by guys who could write. We’re looking for your work, untouched by others. Find the unedited draft that you first circulated. (If you don’t have a draft brief handy, that’s okay. Find the last long email that you sent to someone who matters — to the partner, the client, the general counsel, or the CEO.)

Second, click through this link, which will tell you how to enable Microsoft Word’s ‘readability’ feature on your computer. Enable that feature.

Third, let the readability feature score your work.

Finally, take a handkerchief and wipe the spit out of your eye. (I bet you didn’t realize that a computer could spit in your eye.)

You didn’t notice the spit? Here it comes: Compare your readability score to the average readability score for the works of bestselling authors.

I didn’t even know about Microsoft’s readability feature until I published a column on legal writing last month. I argued in favor of using short sentences and the active voice. A reader — Steve Dykstra, who’s a legal recruiter and budding novelist in Toronto — promptly sent me an enlightening email. Steve also subjected my work — my column on legal writing — to Microsoft Word’s readability test. Steve then told me how my column compared to the work of bestselling authors. . . .

This did not catch my eye because of the politics or that the involved party is the IRS. I was simply in awe that anyone in this day and age of litigation holds and e-discovery could – with a straight face – claim to have irretrievably lost so much computer data.  -CCE

Republicans on Tuesday charged that the IRS has lost emails of a half dozen of its employees involved in the tea party targeting controversy, including a top aide to the now-fired acting IRS commissioner.

In addition to losing two years’ worth of emails sent and received by Lois Lerner, the central figure in the scandal, the IRS ‘cannot produce records from six other IRS employees involved in the targeting of conservative groups,’ Ways and Means Republicans said in a release.

Ways and Means does not say how the emails went missing or what time specific time periods are involved, though they say it includes the period at issue. In the case of Lerner, for example, her archived emails between 2009 and 2011 were washed away in a 2011 computer crash, the agency says.

The IRS says that at the time they did not keep records of or back up all emails. Rather, they relied on employees to archive them on their personal computers after they ran out of storage space in their Outlook inboxes. . . .

For many years, there was no one, best way to review and edit Microsoft Word documents on an iPad, but there were lots of apps that could be used for the task, each with their own strengths and limitations.  The landscape changed in March of 2014 when Microsoft introduced the Word for iPad app – a powerful app that can handle almost everything that you would want to do with a Word document on an iPad.  Ever since then, I have wondered about the future of the other apps that handle Word documents.  Some apps may be abandoned, but my hope is that others will find ways to distinguish themselves from Microsoft’s app.

That’s exactly what has happened with the new Reviewer 7 app.  This a new name for an updated version of an app that used to be called Reader 7, and I reviewed it this past February.  Reader 7 was created by German attorney Maren Reuter and her husband, who is a software designer, and I thought when I reviewed it that it was one of the very best apps for reading Word files on an iPad.  The app’s name was changed because while it is still an excellent viewer, you can now get the app for free and spend $1.99 for the in-app Review Tools upgrade and then the app will let you create redline edits in a Word document. . . .

I’m at ABA TECHSHOW in Chicago right now, and the big news on Thursday was that Microsoft released a version of Word (and Excel, and PowerPoint) for the iPad.  I have been kicking the tires on this app since it was released Thursday afternoon, and I am incredibly impressed.  Unlike Microsoft Office Mobile for iPhone released last year, the new Word app for the iPad has virtually every feature that lawyers want to use.  Every attorney who uses an iPad will want to get this app. . . .

WordPerfect Viewer returns to LawBox, by Jeff Richardson, iPhone J.D. Blog

If you have an iPad or iPhone, you know that your device cannot natively view WordPerfect files. (Yes, there are still plenty of folks in the legal community who use WordPerfect.)

There is an app for that — WPD Viewer — originally reviewed by Jeff Richardson in 2010. Created by LawBox, this app will let you view a WordPerfect document, but you cannot edit it. Regardless, you can cut and paste into a new document if you wish to edit it.

The folks at Corel liked the app so much that they bought the right to sell it. As of January 2014, the app has come back to LawBox. The founder of LawBox, Nicholas Zeltzer, has already updated the app for iOS7. One of the post’s commenters, Charles Jannace, added that the app connects directly with Dropbox.

Although this app does not give you a smooth transition from WordPerfect to Word or back again, it does give you a way to access and copy and paste a WordPerfect document. -CCE
