Does your state have an ethics opinion about encryption of your firm’s email? Do you use encryption? Do you use a secure cloud based platform? If you are not sure, don’t you think you should check?

Most law firms frequently use email over fax and regular mail to communicate with their clients, their expert witnesses, and opposing counsel. What is your obligation to ensure confidentiality of your firm’s email, and are you meeting it?

I may be the luckiest person in the world. I receive emails almost daily from people I do not know who want to give me money. I’ve won the lottery or I’m offered a fantastic job as a “mystery shopper.” And, boy, do I win a lot of stuff! Of course, none of this is true.

On the flip side, the tone may be more menacing. Emails from banks and credit cards saying they need me to respond to address a delinquent account or that someone has used my account. I do not have accounts with these folks.

Even with my firewall and my attempts to avoid viruses, Trojan horses, and other attacks on my computer, bogus emails and spam walk right in. I block these emails, mark them as “junk,” and they still come. I suspect many of you get the same things.

Make no mistake. You and I are targets. -CCE

Refrigerators that automatically help you prepare your shopping list. Thermostats that adjust the temperature to your liking when they detect you are heading home on your commute. A device on the front door that sends a picture to you of everyone who rings the doorbell while you are away. All of these ideas seem great and maybe even a bit magical, and they are headed your way right now. The concept of the Internet of Things (IoT) holds a lot of promise.

Unfortunately, as with all things related to technology, it may not be quite that simple. . . .

Lawyers are also not perfect at Time sheet accomplishing this, leading every company with a time and billing product to tout how much money can be made if only every bit of ‘lost’ time was recorded. But the practice of recording time by hand on paper timesheets really does need to go the way of the Dodo bird.

Lawyers tend to have a love/hate relationship with technology. Of course, that’s often true for any of us who use today’s technology for our work. But for many lawyers, these feelings are quite pronounced and, without offering any amateur psychological diagnosis, I feel many members of the legal profession evidence a split personality when using technology.

So begins my column, It’s Time To Love Technology, in the January/February issue of Law Practice Magazine. I know that statement is easier for me to say, having an interest in technology rather than the very-typical lawyer aversion to technology. But it is time, past time actually, to be updating to technology-based digital work flows. It is time to embrace the fact that the tools of our trade are mainly technology-based tools. We would certainly judge others who did not know how to use the basic tools of their trade properly. It is time. I appreciate that you are too busy and think you don’t have the time.

But, as I noted in my column:

If you are billing a client for four hours to do something that could be done in 20 minutes, you are not doing right by your law practice or your client.

While that being the Director of the OBA’s Management Assistant Program may be Jim’s “day job,” Jim does far more than that. But the best thing about Jim is that we found him first! And we know a good thing when we see it. We may share him with the rest of you from time to time, but luckily Jim has – so far – always called Oklahoma his home. -CCE

Witness Preparation: Best Practices for a Successful Deposition is a really nice article by Tulsa, Oklahoma attorney Robert P. Redemann. I strongly recommend it to any lawyer, even those who might not be involved with depositions. Sometimes it is good to understand best practices in our profession. Share the link with a young lawyer you know.

I would add one other item. Have you looked at the materials you routinely give the client to prepare for a deposition recently? Surely all law firms have progressed past the point of giving clients photocopied deposition tips in favor of custom-prepared materials with the law firm’s name, address and logo. But if you have not reviewed your handouts lately, take a look. A good proofing and freshening is often in order. Use some different sized fonts, headers, text boxes or insert a small graphic or two to increase readability. You never know who may be looking at this document sometime as a representation of your firm’s work product. Make this a professional document you are proud to have carry your firm’s name.

Here’s a great explanation of why you need to use Evernote.

‘Evernote is software that is a digital extension to your biological memory. Remembering ideas becomes trivial….The intellectual demands on professional life can be overwhelming. Great minds are best deployed to the intractable problems to hand. But life is made up of lots of little things that have to be remembered. Evernote stops you wasting effort on remembering all those little things, and liberates your imagination.’

That explanation was written by Philippe Doyle Gray, a barrister from Sydney, Australia. I was privileged to sit in on the session he taught at ABA TECHSHOW on How to Optimize Evernote. He is now sharing his paper and his training videos on how to use Evernote with the world. Sometimes a picture, or a short video, really is worth a thousand words. Check out his online collection of Evernote resources for lawyers. We believe that Philippe was the first Austrailian to give a presentation for ABA TECHSHOW and my guess is that this will not be his last time. . . .

Time management is a challenge for us all these days. There are so many more distractions and so many more electronic avenues for assignments to come our way. It is a constant struggle to maintain productivity and a constant goal to improve. Missing a calendar entry can be critical in a law firm, so we live by our calendars. But making certain that critical tasks are completed promptly is equally important. Many lawyers put critical to-do items or deadlines on their calendars, even though they should be in a task list.

Microsoft has sent out its warning that the “end of life” for Windows XP SP3 and Office 2003 is April 2014. See Microsoft’s notice at http://tinyurl.com/mnn29f6.

What does that mean for those still using Windows XP who have not upgraded to Windows 7 or 8? It means that Microsoft will stop providing security patches and upgrades for older versions of Windows that keep malware at bay after April 2014. If you are still using Windows XP after April, tech experts predict a malware’s open season on your computer.

If you and your IT folks have not discussed this upcoming change, start talking and make adjustments to your technology budget. -CCE

Can Lawyers Be Luddites? it is sort of a trick question. If you don’t know what Luddite means, there is a far greater chance that you are one. I’ll give you more information about the origination of the term later in this post, but suffice to say that today Luddite means that you are anti-technology.

There has been a lot of discussion about how well lawyers need to understand technology since the ABA House of Delegates amended Comment 8 to Model Rule of Professional Conduct 1.1 on Competence. . . . .
