The majority of lawyers in my part of the world aggressively use experienced paralegals and legal assistants to provide lower costs and quality work for their clients. It is simple math. It cuts costs for clients and increases profits for the lawyers. It is a win-win. Yet, there is no dispute that legal fees, which include criminal fines and filing fees, depositions, discovery, and e-discovery expenses, can drive up a client’s bill in a hurry.

Like medical costs for a serious illness, many people find these expenses outside their reach. -CCE

 

In our country, lawyers and judges regulate their own markets. The upshot is that getting legal help is enormously expensive and out of reach for the vast majority of Americans. Anyone faced with a contract dispute, family crisis, foreclosure or eviction must pay a lawyer with a JD degree to provide service one-on-one in the same way lawyers have done business for hundreds of years.

Increasingly, the only ‘persons’ with access to legal help are “artificial persons” — corporations, organizations and governments. No wonder that in a 2010 New York study, it was shown 95% of people in housing court are unrepresented. The same is true in consumer credit and child support cases; 44% of people in foreclosures are representing themselves—against a well-represented bank, no small number of whom engaged in robo-signing and sued people based on faulty information.

While attending a CLE event, have you ever left your laptop unattended? What if someone steals one of your mobile devices from your car or your home — or what if you inadvertently lose it in some way? Can someone else access your privileged client’s data? -CCE

I recently had the honor of writing a piece for ILTA’s Peer to Peer magazine on mobile security and presenting a webinar on the same topic. One piece of research blew me away: in a six-month period in Chicago, over 20 THOUSAND (yes – THOUSAND) cell phones were left in taxis.

Sure, maybe Chicago’s taxi seats are stickier than most, and perhaps the cold forces people into taxis more than in, say, Boca Raton, FL. The point is, you’re apt to lose a phone. And these days, with large amounts of data storage, functionality, and computational power on these things, that spells trouble for attorneys protecting client data.

Microsoft has sent out its warning that the “end of life” for Windows XP SP3 and Office 2003 is April 2014. See Microsoft’s notice at http://tinyurl.com/mnn29f6.

What does that mean for those still using Windows XP who have not upgraded to Windows 7 or 8? It means that Microsoft will stop providing security patches and upgrades for older versions of Windows that keep malware at bay after April 2014. If you are still using Windows XP after April, tech experts predict a malware’s open season on your computer.

If you and your IT folks have not discussed this upcoming change, start talking and make adjustments to your technology budget. -CCE

I was talking to my friend Bobbie a few years ago when John Edwards was running for President — and before it was known that he was not just a pretty boy, but a lying pretty boy who cheated on his wife. I had met Senator Edwards and was one of many who were more than disappointed when he imploded. Bobbie said: ‘Greg, I could never vote for him.’

I asked why? ‘Because he’s a trial lawyer.’

‘Well, shoot, Sis, I’m a trial lawyer. What’s the problem with that?’

It turned out that what Bobbie really hated was the mass media lawyer advertising that encourages people to call lawyers and file lawsuits when they would not even know they had a claim unless they saw the idea on television.

On-the-job bullying can take many forms, from a supervisor’s verbal abuse and threats to cruel comments or relentless teasing by a co-worker. And it could become the next major battleground in employment law as a growing number of states consider legislation that would let workers sue for harassment that causes physical or emotional harm.

‘I believe this is the new claim that employers will deal with. This will replace sexual harassment,” said Sharon Parella, a management-side employment lawyer in New York. “[Y]ou can no longer go to work and act like a beast and get away with it.’

The potential merger between the California-based Orrick Herrington & Sutcliffe and Pillsbury Winthrop Shaw Pittman in New York would have created one of the largest law firms in the country. It was first reported by Reuters on October 25.

Orrick Chairman Mitch Zuklie and Pillsbury Chairman James Rishwain said in a joint interview that a conflict of interest between clients in Orrick’s public finance practice and Pillsbury’s tax, environmental and real estate practices killed the merger.

Sparks then goes deep into the Apple Mail app for the Mac, and this book will be most useful for folks who use a Mac and the built-in mail app. He also reviews many of the best programs for the Mac and apps for the iPhone/iPad that you can use to work with email, and devotes a chapter to Gmail.

Although I think it is too soon to call it, these blogs have been named, to date, the top legal blogs for 2013. Some great blogs may be missing, but everything here deserves the title. There are many top-notch regional or special legal area blogs deserving of high recognition regardless of whether they make a national list. Even though the ABA will not announce its list of the top 100 blogs until later this year, my guess is that the majority listed below will no doubt will make the cut.
