The South Carolina Supreme Court suspended an attorney for repeatedly refusing to follow its explicit rules to maintain and monitor a working email account. This transgression, plus other failures by the Respondent to follow the Court’s orders and rules, led to the attorney’s suspension. The lawyer’s license to practice law was until further order of the Court.

Even when you or your firm have access to Westlaw or Lexis, you may still want or need access to free resources to do your legal research. 

Most, if not all, states provide a free website for state law (e.g., statutes, case law, state constitution, attorney general opinions, etc.). Perhaps the easiest route is to go to that state’s official government website. The state court’s websites use their own search engines – do not expect each to work the same as the others.

Here is another resource that will also lead you to state law: 50 States (http://www.50states.com/). (Click on the state, and scroll down to “Courts” and click on “Judicial System.”

The Myth of the “Litigation Explosion”   

A lawyer wears two hats:  Advocate, and counselor.  As advocate, my duty is to fight for you hard as hell, tooth and nails; to be the knight in shining armor charging into the Valley of Death.  As counselor, I must give you the news and help you realistically evaluate your odds so that you can make well-informed decisions regarding basic questions in your case: especially, whether to accept a settlement offer.

Today I recommended — and my client accepted — a settlement agreement that will barely pay her medical bills.   Why?
